Initial legal assessment

The Luxembourg Offshore Banking Ldt. is active on the websites www.luxosb.com and www.luxembourgoffshorebankingreview.com. On April 23, 2018, BaFin ordered the state, which is allegedly based in Hong Kong and / or Australia, to cease and wind down the deposit business. The company advertises with so-called offshore accounts, which are referred to as savings accounts. The company does not have a license from the Australian supervisory authority, nor can it - as stated on the website - be assigned to the compensation scheme of German banks. Without the appropriate permission from Bafin, it is not permitted to conduct large-scale banking transactions or offer financial services.

According to the jurisprudence, companies or persons who conduct the deposit or lending business without the permission of the BaFin are obliged to pay damages according to § 32 KWG.

It is recommended that investors concerned contact a lawyer with special knowledge of banking and capital market law in order to assert possible claims for damages.
